If they aren't professionals why do they need professional liability insurance.

I don't ever see the expression, "legal survey", except with these types of companies.

Excellent question Mr. Small. My guess is one of two things is going on. One, they are lying about having the insurance. Or, two, they have a policy they are paying for that is worthless. I can't get medical malpractice insurance because I'm not a doctor. If they were to have a claim the Insurance company would see that they are not licensed and would deny any claims.

I would say it's the first one. You can't get Professional Liability without a license.

The contacts page includes
>Corporate Address
>Long Beach, California 90804
>Regional Offices
>Seattle, San Francisco and Phoenix. Services available Nationwide.

I would suggest that that information be forwarded to the professional licensing boards in the named states. The offer of nationwide services will be harder to address. Unless contracting for making measurements in a state it would be considered a drafting service.

The website indicates that they work nationwide. I already sent the site to our board.

Mr. Tompkins that has always been my understanding as well. However, I have recently been made aware of two Subsurface Utility Engineering companies that obtained Professional Liability Insurance in the Metro Atlanta area that did not have a professional registration. Does anyone have any insight into how this works? This goes against what I thought I knew.

I don't know about the companies that you mention but having dealings with locators in the past I can offer a possibility. They do not provide locations of the utilities referenced to property (right of way, easement, etc.) lines but only mark on the ground where the utilities "should" be. They may uncover the utilities and provide a depth but do not provide "elevations". Even as good as the locators are they still cannot "see" underground so they purchase insurance to "cover their butts" in case they miss one or mislocate one.

I think the point was that how can they purchase Professional Liability Insurance if they are not licensed. I'm sure everyone is fine with Subsurface folks having insurance.

The first paragraph references the following section of the Ca. Land Surveyor's Act.

well, they can wave their hands around it all they want..these "surveys" are for more than geologic or landscape purposes...they are using this for building. Let me ask you this...where is the Landscape plan? all I see are site plans, building elevations and other designs.

They seem to be admitting as much.

They are clearly trying to take advantage of a perceived loop hole.
