Surveying in a county 100 miles North of us, just West of the Capitol City...haven't worked in this county, yet. We are consolidating about 15 tracts. I just started reviewing the deeds and the first description I read says, verbatim (keeping in mind that the 3/4" iron pipe is the called-for monument in the county surveyor's office):
"Commencing at a 3/4" iron pipe 1.16 feet North and 4.11 feet East of the calculated Northeast corner of said West Half Quarter Section; thence South 89 degrees 41 minutes 31 seconds West (Assumed Bearing) 480.00 feet to a 5/8" rebar 0.74 feet North of the calculated North line of said West Half Quarter Section and the Point of Beginning of this description..."

Well, on the bright side - at least he didn't completely reject the called for monument.
Someone should have their license revoked.
I'm stuck on the West Half Quarter Section, can't seem to get passed it.

As others have said, at least he/she honored the monument. I can't wait to find out how all this plays out on the ground. It appears that every surveyor North of the Ohio River has been on or around these tracts.

I "guess" he honored the monument. I have trouble understanding exactly what he is trying to say. I think there is much better wording that makes it more clear exactly whether you are honoring the monument as being the location of the "actual" corner.

He must be trying to say the W1/2NW1/4 or something, the way it is makes my head hurt:bored:
If it's the W1/2 of a quarter, then its a 1/16th corner on the north section line or a CE or CW 1/16th, I don't like him saying how far its "off" but he is giving notice in his legal that he's accepting the monument and not even going to the calc, which is really good:-D
So really I do like that, I mean without a drawing explaining that he is using a found monument and that it isn't on the calc; this way is not bad at all, gives you the info, states that he is accepting a slightly "off" monument and rejecting a prorate solution.
Seems clear enough. He accepts the mon and Acknowledges that the math doesn't match but may be useful as a reference tie.
Moe, you're right. He is describing the W1/16 in his own way. 😉
I've never seen a description like this. Since IN is a recording state, it would seem more applicable to show these ties on your recorded plat and reference the associated plat instrument number in the legal. It sure would make it easier to read.
Since he held the pipe (that's good) why even mention a non-existent, mathematical corner?
I like to keep it simple. When I can connect the dots with found, called-for monuments, the math goes out the window. B-)
OK, I think I may understand what he is trying to say. I have re-wrote the paragraph in question for him.

Sheesh Moe, itÛªs right alongside, err adjacent to the East Half Quarter Section. :whistle:

Calling out bearings in that format is nice to see when you are looking at a fax of a copy of a fax of a copy, etc. Thing is, for a new description, that's never going to happen. Five hundred years from now people are going to be looking a crystal clear digital file or they will be looking at nothing at all.
As far as the description generally goes - the calls for monuments is enough by itself to indicate that the surveyor is not holding the mathematical calc'd points. If he is going as far as he did to reference those calc'd points he should have continued and referenced the found section monuments he used to make those calcs. Kent gave us a good example of how that would look last week. Without that the references to the calc'd points just adds a lot of fluff without substance.
But once you peel away that fluff you have called for monuments with bearing and distance calls between them. So that's good.

His assumed bearing phrase is what he's using to denote his basis of bearings. He's using two monuments, "assuming" the record bearing, and then all subsequent bearings are referenced to that line.
Awkward way of saying it, but that's how I take it.
