The situation:?ÿ Guns drawn and a person arrested on some charge
The cause:?ÿ A line of lath along a common property boundary which falls near the center of a rural driveway that extends for something like a half mile.
The call:?ÿ Question number one was asking if I had done a survey for some people I had never heard of, so that was simple.?ÿ Then I asked what county and precisely where.?ÿ While searching for that online I listened to the story of the abuse being inflicted by these people.?ÿ Eventually, I recognized this as being where another firm had performed a survey within the past month.?ÿ I was only aware of that because I review surveys for that county before they record them.?ÿ As I recall they had excellent records to follow and found all but one or two monuments of record over two sections.?ÿ The caller had already had some conversation with an attorney and the phrase "prescriptive easement" had been tossed about.?ÿ I simply suggested that he and his attorney do some research in the Register of Deeds Office to determine numerous facts of record before doing anything else.
Further information:?ÿ I am guessing the adjoiner had specifically requested the lath be set knowing it would rile the caller.?ÿ It worked.?ÿ What neither party seems to know is that the survey crew discovered a document in the Register of Deeds Office relating to the "driveway" and made note of that on their survey.?ÿ I have met the caller a few times over the past 20 years but he did not make that connection while we were chatting.?ÿ I did a survey for his oldest son three or four years ago.?ÿ His wife was employed by one of my banks for about ten years so I had reason to chat with her routinely.?ÿ The caller has become quite wealthy as a business owner and owns a few thousand acres of farm land of which I am aware.?ÿ I only know one of his adjoiners for this specific location and that person is not involved with the current problem.

My son was involved in a case that was based on a dispute over a shared driveway. His client was the family of a murdered man who was strangled on the driveway by the neighbor while they argued about who owned the driveway.
The neighbor was about to be released from prison and intended to move home so my son's clients were trying to stop him. My son said it was the only time when he was in a prison that he felt unsafe while disposing the murderer. These disputes can spiral out of control. Find the local low-baller and send them to him.?ÿ

I did not remember that detail until after I was off the phone.?ÿ I have no idea what that document says, but I recall seeing a note to the effect:?ÿ See Document 1234, page 123 that was pointing toward the driveway area.

I think he was making up a number.?ÿ But in any registry that goes that high there will be a Book 1234 page 123 and if most documents are short, one is reasonably likely to begin on that page.?ÿ?ÿ
That combination is really no more of a coincidence than any other you might pick.?ÿ Post number 500,000 was really no more special a number than any other mathematically.?ÿ We just assign cultural significance to round numbers and patterned numbers.

You know I made up those numbers.?ÿ The Miscellaneous books for easements only go to about 120M, but might have 600 pages or so.?ÿ Deeds stop at about 200 before jumping onto the computer.?ÿ Those are either of the A124, page 124 or 2020-0124 variety.?ÿ This easement probably is at least 100 years old so it would be a relatively low number in the Miscellaneous books and a fairly low number if mentioned in an old deed.?ÿ I don't think it was officially a county road, but I could be wrong.?ÿ That "first in the alphabet" county is notorious for screwy stuff like county roads that were to run diagonally from the southwest corner to the northeast corner of the section.
