Fence location on ALTA - is it an encroachment?

The bottom of a post is frequently a foot or more, horizontally, from the location of the top.

That did come up, but the seller is a good person and has ethics and doesn't want to bully the neighbor.

I understand the hesitance to use the word "encroachment". For those who do ALTAs; do you provide a listing and if so what to you title said listing?

Walt Robillard taught me 40 years ago to call such things "possible encroachments".

Several years ago, language was added to the standards to label improvements?ÿwithout respect to ownership, since surveyors do not determine ownership. We locate and calculate lines of record.
