There was a recent thread discussing "https://surveyorconnect.com/threads/alta-survey-with-no-monuments.319191/&apos ;">ALTA survey with no monuments" and several mentioned that state minimums prevail. I just received an email from Professional Land Surveyors of Ohio stating that "The State Board of Registration has released a special advisory on the preparation of ALTA surveys." The email also provided a http://r20.rs6.net/tn.jsp?f=001Z7qJomLMVC5TU9o3qeTEiiCziYThNB1Cvw8C06BT3pAYfJmssyJ325_KZ-CyzKup0ZHJ9iYhjOcBQirE359NBUVhCgnQeHRFQoUgnPNxudr1WHpTiSyZMNuCB0kI6YhouxxuU4KBF_Hhqkj9fJ-reeTTkR5Tlowoz05cLu8jx17K0KcKVA5h1KflxDWYdRKuUwttPkAFbFb7VdIj1RmoJxyX6V1sDttxy5XHWULZOoSkfOqr2uKutLKUvbqVr4Fk&c=MRmKAn006MewhPs4BFRG_gI0lS4-1EhYERHmu6xA1DHRXan4oi4L_g==&ch=fWIkWC6fGmnL4U6T_deBRaTjemKnBIMw4CkbY1Bo59jSRB6M7f-2Gg==&apos ;">link to the May 19, 2015 advisory (pdf) that includes the following statement:
Please be advised that in Ohio ALTA/ACSM Land Title Surveys are considered to be boundary surveys and must be prepared in accordance with Ohio Administrative Code 4733-37 Minimum Standards for Boundary Surveys. Specifically, when performing an ALTA survey, boundary monuments and reference monuments must be set in accordance with OAC 4733-37-03. Despite the wording in the ALTA/ACSM Minimum Standard Detail Requirements, setting boundary and reference monuments is not optional.
It would appear that the problem discussed here has been brought to the attention of at least one BOR.
Common sense seems to have prevailed in Ohio.
Well, except for that one county that John Francis has been fighting with.
Good job Ohio...
Question. Wouldn't it be a violation to survey in whatever state and not follow that state's regulations first? If you have both covered, then you can't go wrong correct?
That's also true in WV. Within the past year a surveyor was reprimanded, fined, had to go back set corners, redraw his plat, and send it with a letter of explanation to his client.
