it's the kids left behind without a father that I find just heart breaking.

Just because I'm paranoid, doesn't mean they aren't out to get me.

So sad. Apparently they're awaiting the toxicology report on the driver. :-@

The details that strike me are the facts they were working in a residential area, coned-off and set up on or near the curb and John was actually standing in the grass, vested.

I guess it just goes to show that we all need eyes in the back of our heads anytime we're working near traffic.

I don't see what else he could've done there. There was no avoiding it. If someone is going to come zooming by and plow over the curb and into a parked car they are going to kill anyone standing there.

Nothing the survey crew could have done. But somebody might have stopped that driver (I'm assuming that the toxicology will come back strongly positive) from getting behind the wheel.

So Scary and sad. We do road work almost every day. If it wasn't alcohol I would guess texting or web browsing on the phone.

Exactly. Many situations like this can be prevented by not letting your buddy drive after he's had a few. Be a jerk about it if you have to; somebody taking his keys away might have been the difference.

Also, even though they came back to the scene, can't they still be charged with hit and run and leaving the scene of an accident since they initially drove off after running this poor guy over?

Yes indeed they can. But it does look better if they at least came back instead of trying to hide. Doing that gets them into potential obstruction charges on top.
Depending on the state they are in and the state of driver (drunk or not), it might go to charges of wreckless homicide, 2nd degree manslaughter, homicide by vehicle (vehicular homicide some called it).
I have known two people nailed by the latter. One was truly wasted and they sent him for a 14 year stretch but they let him out in 14 months. (go figure)
The other was truly just a plain old accident and they about sent him to the electric chair.
I know most of the details in both cases. Both from reports and in their own words to me in person. Seems me justice went backwards between these two. Then again, these happened in different states. One here in GA and other in NC.

It is a shame and I'm very sorry to hear about John....God Bless Him

I agree with you that something possibly could've been done....you know a couple weeks ago I was on the expressway headed home and someone went flying by, must have been going 110+, they had a tough time going into a big sweeping curve leading to an off ramp....called APS and reported it, you never know but at least you tried to help...
