I had an HOA president call me, and wanted me to survey a house in the neighborhood for evidence of deed restriction violations. They said a lawyer was involved and had "got approval" to do the survey (from who, I don't know). I declined the job, I don't want to knowingly put myself into a potentially hostile situation ... I'm not even sure that is legal without the owner's consent. Seems like an odd situation, that maybe isn't covered by FL's trespass law.

Interesting.

Is there a common area that adjoins? Or just regular lots? Or Street and Alley layout? Because if it's a Common Area, you would think the HOA would have authority to OK treading upon that land, if regular lots, they may not be so accommodating.

Other than that, sounds like a job for reflectorless. 😉

I have not done this. I would want written permission from the landowner before doing things on his property that are not essential to determining his boundary. I see no problem whatsoever with doing what is needed to find the boundary. We find the boundaries of other people all the time while doing most of our surveys. In your case, it may be written into the Home Owners Association agreement that such a step is agreed to upon purchase of any property.

BTW, the hostile situation thing is something we should not get too worried about. That is going to happen rather often in our line of work. Learn to deal with it. It's not just adjoiners that may get excited. It may be other partial owners ( or perceived partial owners)of your tract.

Yup, I've done it. Guy down the street was buying and selling horses and had a huge barn behind his house, emphasis on huge. I forget what the ruling was, but he eventually sold the house and took the barn with him. He was a decent guy and the yard was spotless. No odor at all.

Yep , a big mess to . HOA board member calls me and wants me to survey a new house that is being built because he said the HOA pres allowed the builder to move the house further away from the President of the HOA and closer to his buddys house . wanted me to survey all three houses in the cover of secrecy . I told not until I get written premission from all land owners through each land owners Attorneys .Everyone lawered up . He also told me that the builders Surveyor falsified the foundation survey and wanted me to prove it. I told him not to even send the survey , because my survey will be un-biased. In the end they spent the money for nothing it was all fine.
Its amazing what pride will do to a person that lives in the upper crust of society .

I am glad I live on 10 acres most of the year I cant see a soul.

My dream is 10,000 +/- acres. About 16 sections in a square. Four miles to a side, build in the center and the nearest neighbor is over 2 miles away.

😛
