The BLM did a number of resurveys and relotted the Sections-usually into 16 Lots if they had interest in the entire section. The new Lots only describe the Fed interest while Fee interest is described from the original plats and patents.

Late yesterday I get a deed sent to me for an adjoiner on a project that describes a transfer for a parcel of land as situated in Lot 11 of Section 25. Uh-oh.

The correct way to describe the fee portion of this 40 is the NE1/4SW1/4. If they had purchased title insurance it should (I would hope) cover the costs to correct the deed. However, the grantee is a government agency and I doubt they bothered. Anyway, this is one example where title insurance would have been well worth it.
