ARGH!! What a dummy!

Have been writing descriptions all morning for two complex tracts and an ingress/egress easement that stays as part of the one tract but services the other. About an hour ago I provided the description for the more critical tract to the client to expedite closing activities. Just finished the other two descriptions. Started to finalize the drawing when I realized that my descriptions are all based on the CENTERLINE of the I/E easement being the divide line between the two tracts instead of the southerly side line of the easement being the divide line between the two tracts. Only 15 feet different, but, now all descriptions are wrong, including the one the clients have in their hands. Nobody here to blame but me. **%&*$@&*&*%$&@@**$&%@^#$@&$**&@*&&*%!

Happens to all of us, or something similar will, keeps us humble, that eating of crow. At least you caught if quickly and corrections can be made before recording in the record.

Kinda quickly morphs from a Holy Cow into a Holy Moly Batman... 'hate it when that happens...

I wish I had a tee shirt (better yet a dollar) for every 'gotcha' that got caught before I was really done. Dumb stuff from typo's to offsets to wrong monument id's to forgetting the street name.

At least you caught it. 😉

This raises a good question in my mind. Why keep writing descriptions?

Can't you show it on a plan in a clearer manner? Can't the description simply be "See plan book xxx page xxx," or whatever your registry requires?

We attach plans as exhibits to documents here in MA and I find it much easier to work with all around. I haven't written a description since I left TN in 1983.

As long as the survey plan is recorded. I know there are some mandatory recording states. In PA, the only required recording are the subdivisions. The boundary surveys are usually recorded when they are done in conjunction with a transfer. I don't know how many times I have seen a deed that said "According to attached survey" and the survey is either three deeds back in the chain or is not attached anywhere.
