ALTA: 6(a) & 6(b)

I get so many requests on ALTA Surveys to certify to, 6(a) AND 6(b) as well as 11(a) AND 11(b). 6(a) is inclusive within 6(b) and the same with 11(a) and 11(b).

This drives me nuts!!! And they will NOT look at the wording, all they want to tell me is "the Lender requires both..." It is like asking for Option 1 and 2 when:

1 = a dog
2 = a dog and a cat

And when you finally get them to look at the standards they act like they are doing you a favor "We will waive it this time."

As Charlie Brown would say... Oh good grief.

I often get this, usually from a paralegal who is going down a list and is otherwise clueless. In my transmittal I've learned to state that I have not included 6(a) separately since it is automatically included with 6(b), and the same for 11.

I once had a discussion with a paralegal who insisted they needed 11(a), not 11(b). I finally talked to the attorney and asked her if she really wanted me to erase the underground lines shown on the drawing in order to dumb the survey down to 11(a), and she cheerfully replied, "No, of course not."

The latest favorite is 10 (party walls) on a site with no buildings. It's on their list and by golly I have to include it or else how will they know there are no party walls? Because there are no walls, period, you dummy.

I used to try and educate people like this, now I just happily certify to both. The reality is certifying to both causes no problem. It is like certifying to the same thing twice. Sometimes it is just better to move on to more important things. Just my 2 cents.

I think that it's easy for us to forget that to the lenders representatives this is just a piece of paper NOT a piece of land.

You are correct. I have done it multiple times. It just still chaps my hide, how clueless some people are. Even when they look at it, sometimes they don't get it. "The client just checked them both" they have told me.
