this evening, while combing through a thoroughly disorganized and gigantic heap of documents sent to me by a connection in the city file room, on a project that isn't even mine... i stumble across a deed from 1945 that would have come in awfully handy about 7 years ago.?ÿ somewhere on this forum (i could dig it up) i laid a scenario out involving the city and the state GLO having a little tiff over fee ownership of a creekbed.?ÿ and it turned into the GLO surveyor threatening me with legal action for surveying vacant state land- except my position was that it wasn't vacant and an act of the legislature had basically quitclaimed their interest in it.

anyways, the client got scared at the tone coming down from the state, so they quit pushing the issue and went about their extensive design work without that small tract included in their considerations.?ÿ probably the most thorough research i've ever done- i was in libraries, museums, the GLO archives, the city and county archives, had two title examiners effectively on retainer to dig everything they could find.

i just opened this seemingly innocuous document and there it is- gift deed to the city of Austin, signed by both the governor and the commissioner of the GLO (who, interestingly enough, grew up on the ranch that sat where the subdivision in which i live and am typing this right now stands- his old house is about 200' out my living room window), said deed not only unequivocally conveys all the fee title to that piece in question, but everything else within the city limits that could possibly be mistaken for a vacancy.

i only wish kent was around here to see it.?ÿ he was an invaluable sounding board when i was trying to put the pieces of that puzzle together.

That old Shakespearean phrase ' the lady doth?ÿ protest too much' plays out when people are protecting their own interests or incompetence more than people imagine.

It's not sour grapes and I'm glad you get some redemption where your righteous and valid queries were rebuffed by a bully and probably needs a bloody nose ( figuratively) and most certainly in a professional and public excoriating manner.
