For years there were county planning and zoning departments around the state that thought they had the authority to review plats, any plats, and approve them for recording or turn them down. We had some changes in the law in 2017 that allow us to record a retracement plat (existing parcels, no new lines/parcels created) without any government approval as long as the appropriate certification is on the plat. All other plats must be reviewed and approved or disapproved by the appropriate local government entity. There are some counties that think they should still be reviewing all plats but there isn't much they can do about it. I've noticed some retracement plats bear the appropriate certification and also the approval stamp of the county. Upon inquiring, I learned that some surveyors still take every plat ( even retracements) to the county for permission to record. Permission to do something that they already have the legal right to do, because they don't want to make waves. PLEASE STOP DOING THAT!!!! All you are doing is feeding their egos and leading them to believe that they have some mystical power over plats and surveyors. More than once I have said "I'm sorry, but you don't have the authority to stop me from recording a retracement plat." The clerks of court are very familiar with the law and follow it. One surveyor told me that the P&Z folks in a nearby county insist on him obtaining a boundary line agreement before they will approve a subdivision plat. That is going too far. Please, DON'T FEED THEIR EGOS or you may end up creating more monsters.
