The article gets a little confusing, mixing up the victim's name with the suspect's name.

Six shots sounds like he emptied a revolver into the neighbor, and thus had none left for the surveyor, who was probably as far away as legs could take him by that time.

What I found particularly amusing was the battle over whether to sentence him to 45 years or 55 years.?ÿ The man is 78 years old.?ÿ The final decision of 48 years means he can walk (really?) out free when he is 126 years old.

Thanks for the story!?ÿ I'd like to know more of the backstory on this.?ÿ I understand that they had?ÿ a line dispute, but dang, how mad does one have to be to empty a six-shooter into a guy??ÿ Sounds like the deceased did the right thing and hired a surveyor to help settle it but the ol' codger wasn't having anything of it except his way.

The murderer hired the surveyor so I probably wouldn't expect to see any bullets coming my way-- at first anyway.?ÿ Definitely be offsite when telling the guy the results of the survey...?ÿ ????ÿ

There is maybe the possibility of parole, and the length of sentence could make that practical vs impractical.

Anyone using a cordless hole puncher in such a manner should NOT be eligible for parole.?ÿ But, that's just my opinion.

Hijack warning...

The last time I served on a jury, one of the members wasn't comfortable giving the accused life in prison but was comfortable with giving the accused 99 years. With the 99 year sentence, the accused wouldn't be eligible for parole for 35 years. The accused was about 40 years old at the time.

On the mitigating circumstances, why should the convicted's prior military service have any bearing on sentencing.?ÿ I guess Indian is handing out 10% discounts for veterans just like HomeDepot now.?ÿ The fact that the last 3 rounds were fired while the victim was on the ground on the other hand should.

I would hope my legs would be working and I wouldn't just be frozen in shock.?ÿ

I suppose it depends on what you're looking to accomplish.?ÿ The guy is an old fart and doesn't appear to have a history of violence.?ÿ I would be surprised if he suddenly developed a taste for blood like some sort of hollywood grizzly bear that would kill again if released.?ÿ If you simply want to punish the guy then you may as well just execute him now due to his old fart-ness.

That should be an option in all cases of incredibly long sentences.?ÿ Doesn't matter if they are 25 or 95.?ÿ Six months on death row or what is effectively the rest of their lifetime and beyond.?ÿ They get to choose which sounds better to them.

On a recent nasty neighbor project, when the neighbor came out and started yelling at my client -- and he back at her -- I quietly slipped away, mindful of the likely trajectory of any projectiles that might materialize as I chose my exit route.?ÿ No point in *both* of us getting shot.

Wow!?ÿ Sounds like the old man had enough in his mind and cracked.?ÿ Shot the dog??ÿ Killed chickens??ÿ He'd been threatening to shoot them all next door already.?ÿ I wonder if the surveyor got paid up front before his client got cuffed and stuffed??ÿ What a mess!?ÿ Thanks for finding that!

I would say making threats and shooting the dog would constitute violent behavior.?ÿ Let alone walking up to a human that you wounded and then executing him.?ÿ That might be considered a war crime if you were on the battlefield and it sure as hell should carry a life without parole in the civilian world.?ÿ
