I re-traced the easterly side of a block of patented millsite claims. There is an un-recorded survey for my client of a portion of these millsites, in which the previous surveyor did not find several corners and proceeded to set monuments at record distances. Unfortunately, the monument he started from, the northeast corner of the block, was on a line that measures about 12 feet longer than record. I found what I believe to be an original mineral survey monument 12 feet south of the re-tracements surveyor's monument. At this time the client is only interested in knowing where the easterly line of the millsite block is, so I will not be setting any monuments, as I found all the originals.
Question: As I read the Land Surveying Minimum Standards, I am required to file a Record of Survey map. Is that how other people interpret that?
I'm not familiar with your Minimum Standards, but my feeling is a map should always be filed. It keeps the history of what you found in the Public Record. Just my opinion.
Did you find monuments that are not of record? Then you have to file. It isn't just setting monuments that triggers the requirement.
What Bruce said. When in doubt, just record your survey. If you set a monument or found one that you did not particulaly agree with an set another, then you must record your survey. That's pretty clear in the MTS and somewhere in the AZ laws with some number.
No big deal. Just record the effing thing. It's about $28. Whippee skippee, just add to the bill. If you're in Mohave County give me a call. Lots of Southern county guys that may give you some pointers too, including Mr Small. I know more too, but my fingers are tired from typing such a stupid reply to such a stupid question.
PS - I am the current APLS Secretary and very active on the APLS Board of Directors. Just record your survey and move on.....
