ALTA item 21, require a statment or not?

Does table A Item 21, require the surveyor to make a statement on the map and to state the amount of insurance that is in effect? Or is this just a contract item.We have always just sent a certificate of insurance to the owner.

I have never been asked to make any statement about it, or to state the amount on the face of the map, until today.

Not in my opinion.

The items of table A were to be negotiated between the client and surveyor. If the client is asking, it's your decision to make, if somebody else is asking, refer them to the client and let the client know it is not part of the contract.

I have had clients ask that the item be addressed in the cert. As far as I have gone I have stated that my coverage was in effect at the time of the survey. I did not specify carriers or amounts....nunya...as far as I'm concerned.

I would prefer to leave that off. I've only put it on two that I can remember (same title company).

I do not make a note about it at all. I did have to boost my insurance to cover one specific job though. I just added the expense onto the job. (I typically only do part time consulting and didn't meet the insurance requirement). If that is your concern talk to your insurer. They can usually do something like that if you need them to.

Table A item 21 ‰ÛÒ Professional Liability Insurance: if this is checked, the surveyor has no obligation to put anything on the face of the survey other than to indicate in the certificate that the survey included Table A item 21. Some attorneys are saying that the surveyor must list their coverage on the face of the survey; I would categorically refuse to do this and it is not required

E&O Insurance is usually for your client and not for those listed in the certification. I have been asked by para-legals reviewing the map and associated documents and have always politely referred them to my client.
