Wow! That's crazy! It will be interesting to see how this plays out.

I've only seen one other time where the property line went through the edge of a garage and nobody got their garage sawed in two.

Miles ƒ??established a boundary line through the center of the garage, even though he could easily have identified the location of the boundary monument (to wit: the edge of railroad ties located several feet northerly of the said garage) by taking a five minute trip to the town office, where it is clearly depicted on photographs which are part of the assessment records,ƒ? the complaint said.

This is my favorite part

@thebionicman I'm using Firefox with an ad-blocker. I've found that I have less trouble with pop-ups and "you are using an ad-blocker" messages if I open such a website in a private window. I used a private window to read the linked article, and had no difficulties.

I'm puzzled why two surveyors disagreed by multiple feet. Was the deed that split the properties in the past that ambiguous?

And it irritates me that the story keeps using the phrase "middle of the garage" when the cut is far from the midpoint.

@thebionicman

I'm using Edge, which has a built-in popup blocker, so I didn't see any of those. ????

There is a county seat town nearby that has several examples of garages built by neighbors such that half is on one owner and half on the other.?ÿ These are relatively narrow lots with little opportunity to construct a garage.?ÿ Somehow the city allowed this to happen.

They jump out at you as one half may be red and the other half white.?ÿ One side of the roof may be shingles and the other side is metal roofing.?ÿ You know eventually one side will fall into disrepair while the other is maintained properly.

It is hard to render a reasonable opinion without reading the appropriate deeds and seeing both of the surveys. The trees with wire may or may not be evidence of the actual property line, but I saw no information that either or both of the surveyors were included in the lawsuit.

Assisted in a survey many years ago over a property line, debris and trees. The corner was a tree that A had cut down. We proved that owner B had senior rights to the land in question but because B could not keep his mouth shut in court he ended up having to buy his own land back. Judges have rather extensive powers.

Saying too much in court is really stupid.?ÿ Had a survey job to cut out an island in the middle of 80 acres where the house was located because the recent ex-wife wanted it and the recent ex-husband wanted the entire 80.?ÿ He foolishly announced he wouldn't give a nickel for the house.?ÿ The judge immediately awarded it to the ex-wife since it was of such minor value.?ÿ He also ordered the creation of an access easement along the existing route.

How hard-headed do you have to be to get into a dispute with your neighbor over this crap?? What's he going to do with that worthless strip of land anyway? Climb up the retaining wall and chill next to the garbage fence he threw up and stew in his own anger? Wow, some people need to get better hobbies, life is too short.?ÿ

Not far from the house where I grew up there was an old house with only half of the structure still standing on the foundation. The story was that there had been a divorce and the guy's wife got half of the house, so he gave her half of the house. It was right off the state highway and I don't think I ever went by there without thinking about that. The remnants are long gone now, 50 years later.

@paul-in-pa "Also named in the lawsuit are Darrell Miles of Glenburn, whom Brawn hired to survey the property on which the garage was located"

@drew-r

Sometimes there is far more to the story.?ÿ You know the battle didn't begin over a boundary dispute.?ÿ Little things like the neighbor catching you in bed with his wife.?ÿ Or your dog ate the neighbors pet rabbit.?ÿ Or his dog craps in your yard every day. Or your kid is the star of the basketball team while his kid sits on the bench.?ÿ Or...............

@holy-cow that's my point. It starts with something else and it is allowed to fester into situations like this. People get into arguments over stupid stuff instead of admitting any wrong or *gasp* listening to each other for goodness' sake. It may have been remedied with a "hey neighbor, I see you're spreading woodchips by the wall here. Is there anything I can do to help?" Of course, this takes being reasonable so that's probably not an option for some.

There's always a "reason" someone does a galactically stupid thing, it may not excuse it though. I like how the guys' wife declined to comment... this is probably one in a long list of stupid things he's done because he can't get past his ego.

I believe the NE corner of this house was cut off by CALTRANS when freeway was constructed in the 90's.?ÿ It was an old house in the middle of nowhere (Coachella Ca.)?ÿ before the fwy.?ÿ It stuck out like a sore thumb when the fwy was new and no trees.?ÿ Jp?ÿ

I am using Edge and the ad popup would not let me read the article unless I allowed ads.

I don't blame the guy, honestly.?ÿ You just really need to look at what's transpired.?ÿ One owner wants to reclaim his rightful property without any of the bs.

He can't do it because it's harmful, and beyond the pale, so to speak.

The neighbor just named half of the State of Maine in a civil suit, enjoining them in lengthy and expensive litigation that could cause great financial harm. ... but that's alright ??
