I did an ALTA survey on a property and the title company has requested I sign the attached form, which I have declined. They claim that other surveyors have signed it in the past. Should I sign it or hold my ground?
I hate to be an absolutist but I would never advise making that certification under any circumstances, unless of course they wanted to compensate me an amount equal to the supposed value of the property.
I wouldn't sign it. They need to go to the proper Agency and have them fulfill their request.?ÿ
Nope.?ÿ That goes far beyond our function.?ÿ And, beyond our liability.
As cow said, not what a surveyor should be doing.?ÿ If they want verification of franchise utilities and municipal utilities, they can call each and verify themselves.
Hell no. Utility service access is not even close to a survey matter.
I would bet they don't care who signs it as long as somebody does. They just want to check that box off on their list.
"Other surveyors sign it" is a standard trick, might even be somewhat true, but this is way out of what we do.?ÿ
?ÿ
I might sign it if I had certification letters from each of the utilities. That would take time and money to acquire. Make up a proposal with costs to provide this out of scope service. Don??t be shy about the costs. This usually makes these things go away.?ÿ
if not, ask your insurer what they think about providing such a certification. They will probably give you a letter explaining how your E& O will be null and void if you do. You can show that to the attorney, and say ??gee, I??d like to help you out, but I just can??t.?
Just say NO!
