TEXAS TOPO'S AND THE STATE TAX..AGAIN

Are topo's for design taxable. I am thinking this was covered some time back. I remember that EC's are taxable.

Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.356, Paragraph 9

I especially like:
"or to determine or confirm the location of structures or other improvements in relation to the boundaries of the property by the use of relevant elements of law, research, measurement, analysis, computation, mapping and land description."

As a member of the TSPS Chapter 13 (Austin), we had a State Comptroller rep visit us and give a Question/Answer session during a luncheon a few years back. The answer was at best, ambiguous.

As a practice, I need to know the limits of my client's property for design purposes, I propose (2) phases/tasks.
Task 1 is boundary verification, and is taxed, and broken out on the invoice.
Task 2 is design topo and not taxed, and charged separately on the invoice.

If the final product is plotted/delivered as a "Boundary AND Topo of..." the word among some is the whole thing is taxed.

We don't tax for topo but do for boundary. and yes, it sucks.

We use two different job numbers

One is when we are working on the boundary and/or locating the boundary to set up control

Other is for taking topo and relief shots

A good rule of thumb to determine if it is taxable is:

Does the TBPLS require that you sign the map? If yes, then it is taxable.

@Bryan, you are right, the tax code, as it pertains to surveyors, is convoluted at best.

State of Connecticut has a personal property tax on almost everything you own due every year, in addition to all other taxes and fees. I.E., you have to pay a personal property tax on all registered automobiles, trucks, etc., in addition to tag/registration fees and gasoline/fuel taxes.B-)

All I'm getting at, is that the State (no matter which one) is going to get their pound of flesh (tax revenue) regardless if it is through a survey sales tax, state income tax or tax on personal property. No use for any of us to be amazed on what someone else's state chooses to collect tax on - taxes just bite big time, period!
