Like they said above:?ÿ that attorney is an advocate for his client and his client wanted him to talk to you.?ÿ He has done his part and I hope that ends that.?ÿ I agree: talks should be in a courtroom or under deposition with "everyone" present - you, your attorney, that attorney and his client.?ÿ And someone needs to pay you to do either or both. I agree that the survey plat speaks for itself.?ÿ?ÿ

hell yes. Every single person deserves to get paid for their effort.

FYI: don't get yourself labeled as a "fact witness"...they get hardly enough to pay for gas money. "expert witness" gets paid much better, Much Better if you Demand it.

The Attorney we are using for a family matter is $400/hour, he charges to the nearest 1/10th hour. I give him credit, he is definitely NOT milking the job but it adds up. Attorneys bundle everything in one rate, no separate charges for secretary, etc.

It should be, but the vast majority of the surveys I see don't explain the reasons for their boundary determination.?ÿ?ÿ

the Attys I now know work on a flat fee, brief scope of services, then the associated Fee. Kinda like how we did Surveying , Fee based.

Is your client represented by counsel??ÿ If so, it's a violation of attorney professional responsibility rules (ethics) to try and get around that counsel and talk with your client or your clients experts (you).?ÿ Your client needs an attorney and needs to declare you as their expert.?ÿ Otherwise, it's up to you whether to talk with opposing counsel or not.

If you are asking if most work is done T&M, I don't think so as a rule. At this time, the work being in high demand, most surveyors can scoff at a request for an NTE number, quote a very high fixed fee, or go T&M.?ÿ Clients may be choosing to go T&M more often than they might in other market conditions.?ÿ ?ÿ ?ÿ?ÿ

Lay low, but be friendly to your former client.?ÿ Also, quoting prices for more work regarding a dispute can sometimes offend some people such as your client who might think you made a survey error. It might not be a poor in-house investment for you to check your work at your expense. If you do talk to your former client, don't use any rhetoric, and keep it simple, nice, objective and brief.?ÿ If you have any feeling that you might have done something wrong, call your insurance carrier if you have one.?ÿ If not, just quietly keep your fingers crossed and don't bump the wasp nest.?ÿ Do not assume that the other side and their lawyer are insane.
