HC: Hello
PON: Hi, this is Bxxxxx Dxxxxxxxxx and I need a survey. How much would that cost?
HC: Well, that depends a great deal on what you need and where you are. Fill me in a bit.
PON: My neighbor just had his property surveyed and now he's trying to take our driveway and our only access to the back side of our property.
HC: I see. You live in the country. How much land to do you have and where are you located.
PON: We have 14-1/2 acres. We live at 6497 Scott Road in Wxxxxx County.
HC: 6497 Scott Road, eh? I'm thinking your neighbor might be Mr. Dxxxxxx.
PON: That's right! How did you know that?
HC: I just completed a survey for him. Do you live in the house with 27 cars of varying ages and makes?
PON: That's us. You did the survey wrong. The register at the courthouse shows our property going along the fence on the north side of the driveway.
HC: Ma'am. That's the old north fence that was on the north side of the county road that used to run all the way across this section from where your house is to a mile east. If you far enough east you will find another fence forty feet south of this one.
PON: There ain't never been no road through here 'cept our driveway.
HC: It was opened in 1885 on a forty-foot right-of-way. The east half was vacated in 1922 and the west half was finally vacated in 1947. Nobody ever got around to building a new fence along the quarter section line down the center of the old road. Your property lies to the south of that line and Mr. Dxxxxxxxx's land is north of that.
PON: You are wrong............................................................

Surveyors are never right, so sayeth a few in the magazines and a few on the forums. Let angry neighbor get a surveyor, who will probably be wrong too!

Actually, that is precisely what I suggested to her and her husband when he started telling me how stupid I was. This is one of those houses where everyone is always home because no one has a job.

HC, you missed out on a chance to make a (few) buck(s) and go out and agree with your own survey...

Shame on you... Surveyors rarely get an opportunity to agree with themselves so unequivocally...

A really, really BIG opportunity missed.

It's all fun and games until the neighbor gets some Surveyor to go along with their cockamamie theory and then your client has to spend $15,000 knocking it down. Fortunately the Attorney got summary judgment which cut down the potential bill considerably.
