Illinois Prevailing Wage Act- Case update?

There was a dispute case going to court in May, I believe the 9th, about whether or not Survey Technicians should be covered under the Prevailing Wage Act in Illinois.

Any news on if a decision has been made?

Don't take this as definitive, but the Prevailing Wage Rates documents for June 2014 have a line drawn through Survey Worker and a note "Not in Effect".

Its my understanding that a judge threw it out since the Illinois Department of Labor didn't have a hearing on the issue like they were required to before they implemented it.

Good luck with that...wait until the unions get a hold of that decision. Keep in mind that on Federal Projects, the US Dept of Labor has ruled that Davis Bacon wages are required to be paid to survey technicians.

Anything with public money involved (other than straight boundary) requires PW rates in NY anyways. For construction projects in the NYC and lower Hudson Valley region we have to pay $90+/hr (including benefits) to crew chiefs.

For now at least it got shot down. I don't figure the battle is over yet. There is kind of a similar situation going on with material testers, such as nuke testing and concrete testing.

I am going by the NY State Rate for NYC not the NYC Rate which I think only applies to city contracts.

It should also be noted...that when I worked for the City of NY (DEP) as a surveyor I made no where near that rate. They force the consultants to pay that rate but they don't abide by it themselves. NYS DOT does the same thing.
