I am actually going to be dealing with a situation similar to this very soon. I'm going to send out a certified mailing to an abutter who has put a fence up over a boundary line, and posted a sign to their neighbor 6' tall and 12' wide saying "Stay off my property!!"

Of course we have to walk on his side of the fence (since it encroaches) to survey the boundary. I usually tell the crew just to "tread lightly" in these situations.

As an aside, I had a lawyer tell me recently that I'm not really allowed to quote the Ch 266, Sec 120C statute in my letter. Anyone else ever hear of this?
