http://www.ebay.com/itm/BRAND-NEW-JAVAD-GPS-TRIUMPH-LS-RECEIVER-FEATURES-864-CHANNELS-3-YEARS-WARRANTY-/131079114436?pt=LH_DefaultDomain_0&hash=item1e84ec8ec4

He says he is selling a JAVAD gps system. It's bait and switch. He has nothing to sell.

How do we shut him down?

I clicked buy it now.

And, IF he really has one, I'll drive to Florida and pick it up.

Nate,
Looking at the coordinates shown in the picture, you might have to go a bit further than Florida.:-O

Call 'im up, and ask about the Javad. I did. He SAID that he was having trouble getting the ebay ad down. I'd like to buy that Javad. At that price.

He said the Javad was too hard to use, and that he had this nice other piece of equipment... and proceeded to try to sell me something else.

Call im up. Try it. If he has a Javad, at that price, I'm interested!

I've dealt with "Nick" from Wesley Chapel before at a former job, he seemed legit at the time, and has OK ebay ratings.

Nate,
The photo shown in the Ebay add had coordinates and an aerial...

Nick may be fine. But if he is, he should sell me a Javad unit, at that price. Or 5 of them, as his ad says.

Or he should remove the Javad from his ebay ad.

Put up, or shut up.

I clicked "Buy it now"

I just got this email. 3 months ago, he gave me the same story.

If this is not "bait and switch" what is it.

Take your ad down, or sell me one.

Here is his reply:

Dear nate_surveyor,

Unfortunately, we are having technical difficulties with our eBay account
and are unable to take this listing down. We no longer offer the Javad
GPS'. We do however have several Pentax GPS' in stock. One brand new Pentax
G-3100 GPS would cost you $17000 for a complete set up. This is the listing
for the Pentax eBay# 131213617023

If he is having trouble, customer service can help him.

http://ocsnext.ebay.com/ocs/sr?query=1475&topicName=Report+an+item+or+listing&st=6&levelHierarchy=2|3|6

I've turned in a fraudulent listing before. After my claim was initially rejected (I think the first reply is from a bot), I repeated my complaint in detail and the listing was struck.

Purchased a Total Station from him two years ago. The total station itself was the same one as shown in the pictures, but the case was for a different unit.

I was uncomfortable with two things:

1) The case was not matching nor the one in the photos. His problem.

2) The total station looked rougher in person than in the pics, but I am certain it was the same unit unlike the case. My problem.

To his credit he took it back and refunded my purchase price as well as S&H.

I would call my experience with him good.

However, I would not like to be treated as you have been and I think ebay frowns upon this. You might mention that to him.

I have bought from this guy on ebay. He is a numpty.
Prices change minute to minute, delivery likewise, questions not answered, instrument out of calibration. I would not recommend dealing with him.
That said I wouldn't class him as fraudulent, just incompetent.

Bait and switch is fraud.

Go to his ad, and click "Buy it now".

Don't pay for it.

Wait a bit, and you will get the same email I got.

Just got another email from him

Dear nate_surveyor,

Buyer

As I said before we are having technical
difficulties. I do not appreciate you calling it a classic bait and switch,
it was an honest mistake. I will cancel your purchase. I do not wish to go
any farther with this transaction.

Sincerely, Nick

To me, it's fraud if he takes your money and sends you nothing, or something you didn't want ... I've actually met this guy, when I was working near Tampa, we had a metal detector quit, and the boss sent me there to pick up a new one on the spot, as we were quite a ways from the office. He has an office, rooms full of equipment, and sold me metal detector. He does run a legit business, but mostly used equipment, from what I can tell.

Seems like he's being upfront with you about what he has to sell and what the price is, and didn't try to cash in on your "buy it now". But I agree, the ad should not be there if he doesn't have the same units to sell. Perhaps he does have an Ebay issue, like the guy that knew the password quit ...

His price does sound "too good to be true", though. But I've heard of local dealers selling CHC's almost half the "website" price, so maybe not.

Anyway, complain to ebay, and they'll probably take the ad down.

All of you that have had good experience with this guy, that's a separate issue from what Nate is trying to say. The bottom line is, is that this ad (I've personally seen it many times) has been on Ebay for months, if not more than a year. If he's savvy enough to post an Ebay ad, then there's no reason why he can't figure out how to take it down. I'm sure Javad would love to contact Ebay about it and have them take it down. It IS bait and switch. Folks need to see it for what it is.

Javad's response to the matter, on his own discussion board: "It is spam."

The photo on eBay also sowed the unit inside what looked like a trade show.
