Outrageous land owner - This was a first for me

I did some R/W work a couple of months back for a new aerial line in a rural area.?ÿ The adjoining property owner was adamant that the new line wouldn't be "touching his property anywhere"...so I spent an extra hour or two making sure I knew 'zakly where the property line was located.?ÿ Luckily the fence was just about on the property line.?ÿ I remember this fella explicitly because he bird-dogged me for two hours from his side of the fence.?ÿ And the jerk would never even talk to me, even when I spoke to him.?ÿ?ÿ

I later heard the construction crew got into it with him because some dirt from the pole truck's auger had spilled over on his side of the fence.?ÿ Someone had to go back out there with a broom and 'sweep up a few dirt clods'.?ÿ All in a day's work I suppose.

This nut called me this morning.?ÿ Apparently the easement I prepared for his neighbor has been filed at the courthouse and he has a copy.?ÿ He's reading me the riot act because "something" is over on his property.?ÿ It took a few minutes to understand what he was saying...but he finally got his point across...

He's upset because my easement drawing has TEXT drawn over on his side of the property line!?ÿ?ÿNow this guy is serious as a heart attack.?ÿ I couldn't contain myself and started laughing...which only enraged him.?ÿ He's apparently "gonna file a injunction" to make the easement "null and void"?ÿ (even if you could, who cares?) and then "sue the pants off me" unless I change the easement drawing.

I politely told my contact info was on the easement drawing and I would await notification of the litigation.?ÿ He was still talking when I bade him a good day and hung up.

Now I've been surveying longer than there has been unleaded gasoline..and this was definitely a first for me.?ÿ

I brought up the fact, once, to an attorney/surveyor, that; when I drive a rebar in the ground, and put my cap on it; three fourths of it is on someone else's property, and that I was technically encroaching on the neighbors'. They didn't necessarily want to be surveyed and might take offense.

His response was: Good luck getting a judge to agree that they had suffered damages worth compensating.

Did you tell him; it had not been there for the statutory 15 years, so he was safe:

In order to claim legal title under Oklahoma adverse possession law, an individual must occupy the property for at least 15 years, while the rightful landowner has two years to challenge the adverse occupation.

Hell no.  All the counties I work in have gone to letter size documents with a 1" border all the way around.  While three of those counties will allow a legal doc, they charge double for filing.  With a title block, ownership, description and all the regular notes space is at a premium.  It's like trying to adequately draw a section boundary on a 5x7 note card.  It stick text where it fits.

Thanks.  I needed that belly laugh.

That idiot probably has a dozen cameras focused on the scene so you would need to make like Halloween with a full body costume of some sort.  But, Lordy, that would be hilarious if you could get away with it.  Anonymously notifying the local TV station early the next morning would be a nice touch.

I think it is great, so pure an interpretation.

Reality and the depiction of reality collide; it is the corrupted inverse of the contractor who needs you to paint out the features in the field to answer questions that could be solved by scaling the drawing.?ÿ?ÿ
