@wa-id-surveyor?ÿ Right, what you say certainly makes sense.?ÿ It makes me wonder if there would a case for failing to exercise the standard of care though.?ÿ It seems like a judge could say "Given these circumstances you should know better..."?ÿ But yeah I'm guessing a lot of guys wouldn't tempt fate.

Would that get me off the hook for liability?

That would be a good question to ask your E&O Insurance carrier...

Update.

The contractor ended up sending an email to the Town and the engineer. Later that day I got an email from the contractor saying that the corners would be marked on Monday.

On Monday I had to do research anyway so I grabbed a few deeds and an old map done by the same engineer 40 years ago.

Yesterday I went out and found 4 new wood stakes marked "property corner". There was no iron in the ground but 2 of them did fall in the right of way fence and the 2 on the railroad were 33 feet from centerline.?ÿ The pavement that I was asked to stake fit almost exactly.

I was still skeptical so I staked the adjoining deed (the description was newer with bearings and distances). I ended up finding 2 monuments on the other end of the adjoining lot that hadn't been recently recovered. They checked within a few tenths.

Obviously some survey work was done for the project but it wasn't noted.

Gregg

Thread hijack: Interesting that you have a 1-chain RR width. Is that mostly an eastern state thing? Around here they are 100 ft.
