It is a little scary, though, giving eminent domain rights to private enterprise. I'll stop at that. Don't want to get into all the political plusses and minuses involved.

Take a weekend drive North and East of the two major highways along the front range and you will see little pink stakes along grid lines and tracks from the seismic trucks following close behind. Lots of planning money on the ground for the past couple of years at least.
From the summary it looks like they are trying to reverse by statute an upper court opinion from May 2012.
