Is the debate about what I refer to as the bogus theory of subdividing a section of such intense debate within your ranks, that a decision of the policy of BLM Cadastral Survey, cannot be issued?
This is soon approaching a year since I initiated a request to the BLM Director to issue an official opinion on subdividing a section.
We all are well aware of the fact that there are distinct differences of opinions within BLM on how to subdivide sections and don't you think it is about damn time that we all find out what that opinion is?
I also know that I am not alone on wondering about BLM and it's policy!
I have recently testified that it is BLM's policy to accept local/private surveyor monuments that are not necessarily in the exact position of those protracted lines and am wondering if I testified wrong?
You all know and I know what the policy is and can't we just see it in writing from the Director, BLM, who has the delegated authority from the statutory authority of the Secretary of the Interior.
It may well be embarrassing for some, but ain't that the way it works?

I have a 'mess' of miscellaneous junk stuck in the back of my 'old' 1973 Manual. I was looking through it earlier and came across this memorandum.
Thought it might bring back some memories for you.

That does bring back memories all right. And it is a perfect example of what I am attempting to do now.
That is, have a written opinion or decision document from the Director, BLM on explaining in more detail of what certain guidelines actually are intended to convey.
I am sure that you have more of the same type documents in your Manual, as I have written several such documents.
There were disagreements on the verbiage in the official field notes and this Instruction Memorandum was issued to clear up any misunderstandings.
Why would it be so difficult to explain the BLM's guidelines on subdividing sections and taking nearly a year to determine the national policy?

I have just went through my last 15 days or so of mail, that was on hold in the Post Office, while we were gone.......and no letter from the BLM!
Must have one hell of a time making up their minds on the bogus theory on subdividing sections!

Maybe they are preparing Instructions for a Corrective Resurvey of the township involved in the Lozeau case?

I know that certain land surveyors out there are sitting back and smiling at the sequence of events on here and others are sitting back and wishing I would go away.
But, I ain't going away and it is only going to get more embarrassing for those who can and should respond to what I am requesting.
Hey guys, get off this community organization thing of keeping everybody happy and start acting like land surveyors in the Washington Office of Cadastral Survey and the only ones who can issue documents that have the authority of the Director.

Well keep saying the government has too much money and see how much quicker you get your answer from fewer people.
That may make sense to some, but not to me?
They should hire you to write the answer for them.

I think the main reason they haven't responded, and probably will not respond with a policy statement either way is because they have some state offices and surveyors (oops I meant) cadastral engineers that are performing surveys and interpreting the Manual on this issue that contradict what other state offices and surveyors (oops, did it again) cadastral engineers are doing in following the plain language of the Manual.
You can only imagine what a definitive statement could mean for those surveys, bureaucrats, and surveyors (dang, whats wrong with me?) cadastral engineers that haven't followed the plain language/law.
ps - I still haven't heard anything from the court.

I do actually believe that I will receive a response from the headquarters office and will come at a time when they stop trying to please all factions, without stepping on toes, and start acting like the Land Surveyor leaders of the United States.
One has to believe that when it is known by all surveyors within BLM, that a certain faction within their ranks are not following the Manual, that it would be time for a decision on what the Manual intends in it's guidelines.
Maybe time for more BLMers (present and retired) to step up?

I am well aware of the fact that any decision document from the Director, BLM, on explaining further on how to subdivide sections, will necessarily be in conflict with other written statements in certain books and will necessarily be in conflict with the language in the Florida Appeals court case, Lozeau!
And of course in my opinion, the above conflicts should and need to be addressed and why I will continue to push this agenda.
Being leaders in the survey world is not an easy task and should be taken very seriously and while on their watch, do what is necessary!
