New high dollar subdivision, developer is just finished paving the road and I was called in to as-built a buried conduit the developer had?ÿput in under a road that my utility client needs to use as the developer crushed their existing conduit. Section corner got buried by the developer with nearly 4' of fill and I need to tie it, but it's down a rabbit hole now.?ÿ I seriously thought about bringing a backhoe. Is the developer under any obligation to have this section corner reset or should I just break out the backhoe and make a giant freakin' hole in his lovely landscaping.?ÿ

I doubt the developer has a legal obligation to have the corner reset or raised to the current surface.?ÿ But it would be really nice if he did.

Convince him that surveyors will be needing access to the now-buried corner well into the future and that lots of disturbance will happen to his fresh landscaping.?ÿ Better to reset now, especially as it appears you've freshly excavated the original monument and can easily reference it.

Then do everybody a favor and file a corner report explaining what was done.

It depends on the State. Around here the Engineer who signed the plans would have had to show it. The entity that buried it would have to fund replacement. Alternatively they could pay a $1500 fine plus costs. Of course that assumes somebody will push the issue...?ÿ
Bring out the backhoe.?ÿ Your point was there first, and everything the contractor built was based upon it.?ÿ Kinda need to know where it is.
Turns out this is the tip of the iceberg. Several other primary monuments in the area were buried or obliterated by this developer. We did a survey in the area in 2002 and recovered a number of rebar that should be controlling on this subdivision, but were never looked for. I did, and they're still there. I've documented what I've found and am?ÿforwarding it on to the people that actually have some authority and I hope they drop the hammer on these clowns.

Monuments get destroyed during development, you can not leave a 4 foot hole just for a Survey corner or not install water meters and other utilities. We all wish the yellow dozers would leave the property cornes alone, but they always seem to take them out.?ÿ
Does the City allowed the survey corners to stay where they are and allow the houses to flood, or allow fill to be brought in and cover the corners??ÿ ?ÿ
Write on the back of the Survey Marker, dig 4 feet down, or just reset it, and move on and let the next Surveyor thank you.?ÿ

All very true. I'll argue though that if the surveyor does not care for,?ÿnor take responsibility for preserving and perpetuating?ÿmonuments and thus?ÿstable boundaries, who will? Around here the ground is frozen half the year or more, so for half the year under 4' of fill?ÿthey are inaccessible, because of ...?ÿindifference? Lame.

Thank is a great point with the frozen ground and snow, I never dealt with a frozen ground before, so I did not think about that.?ÿ
I am sure they got a permit to bring the fill in, it's their land they are allowed to. I think you need to call the developers Surveyor and ask him about the future plans of the Section Corner under 4 feet of cover.?ÿ

Certainly your state has a code or law covering this??ÿ Each state I work in has this clearly spelled out in regards to the responsible party.?ÿ That is who you need to direct your focus on.

Done. The people with authority over this new subdivision now have documentation on a number of issues. Apparently it's been an ongoing problem with the surveyor and developer but they don't have resources to document the problems. Now they do and my work here is done. Moving on.
