Today, I have a meeting with a team of our lawyers to discuss how we write legals. One of first goals is to discuss when calls are made to a station and offset that don't show on the plans. The Attorneys view is if we call it in the legal it must be on the plans. Our view is the station can be calculated based on the other information in the legal. Also the station and offset is supplemental because bearings and distances are given to each point. The way we try and craft our description is to put emphasis on the property lines so as to not create gaps between owners. The legals are for transmission lines. If they would let me I would put plus/minus on all the distances to the property lines. Anybody have any good case law on this?

The big goal is to try and change how we craft legals. What we want to do is record the right-of-way plans in the courthouse and then the legal would be a simple lot and block type description. I know I can record them in Georgia. Does anybody else know if this possible in TN, AL, KY, MS and or NC? Your thoughts?

Have read the new standards for Mississippi? The limits of easement/right of way with very few exceptions has to be monumented. Monuments have to be shown on plats and all descriptions have to call for monuments.

Is there a weblink to these new standards?

Personally I like to see all the information on in a description on the plat, in case there is a typo error it can be caught.
