So my son was looking at our wooden ruler and asked me why 3 came after 1. I had never noticed. This is the way it came new. There are two 3 ft. marks a foot apart.

Ever have anything not close by a foot? This could explain a lot of those. Are you worried about anything being a foot off?

So, the only problem is that one foot between exactly 2 and 3. After that everything is normal. Right?

Yes, just the one 6" section is off a foot. Makes you wonder if this was a one time mistake or a batch mass produced that way.

It was probably a special batch designed to only be sold in Texas (to keep things "complex")

That probably happens more than we care to admit. I was at a seminar a few years ago, and the speaker held up a folding rule like that, and had it had the same error. I cannot remember the subject matter of the seminar, but this is a good reminder to always check your equipment when it comes in. He said he kept the rule so he could incorporate that into his seminar as an example of a potential error while measuring.
