Can a non-licensed individual perform construction staking in NC? It would not involve any boundary work, easements, or work in public ways.

Thanks for any input.

in NC a non-licensed person can work for a company and perform stakeout work internally for the company, he can not offer those services for hire. He must be a company employee and that company cannot offer services to third parties.

Is this work restricted, then, to land owned by that company?

No. Not restricted to company owned land.

But it is restricted to company projects.

For example contractors who want to hire some guy off the street to stake buildings for them is free to do so. But they can not offer to stake buildings for others.

The theory is if the contractor makes a bad choice and gets an employee who screws things up, the harm will fall to the contractor, not to the public.

I believe the answers given above do not conflict with the policy paper you reference. There is nothing that prevents a construction company from asking any employee they choose to stake for them on their projects only. As Cliff pointed out, the person must be an employee and not an outside contractor. (Outside contractors doing this sort of work would in fact be offering land surveying services and would have to have a valid license to do that.).

Am well familiar with that position paper as it was our local chapter of NCSS that started the ball rolling on asking the Board whether construction staking was in fact "land surveying".

My answer was based on my knowledge of the board rules. I suggest if anyone has questions about the policy, it is always best to contact the board as I have seen some interpretations from the board that are rather "interesting".

It was at that same time when the Board determined 3D modeling fell under the Engineering/Surveying practice. My question is why can an engineer create 3d models but not do construction staking?
