In this case, there is no excess of the section, being Section 25. The issue here is writing descriptions without surveying the property and assuming a perfect 80 chain x 80 chain section is correct when the section is actually elongated. The lesson I wish to pass on to the younger generation is make sure your research is complete before making a boundary determination and writing a description that will last for decades to come. Get the GLO plat and field notes for your area. Never assume a section is 80 chains square.?ÿ A negligent act today will be expensive to correct tomorrow.

Save the field work until after you know what you need to know.?ÿ In my case from earlier this week, I made the mistake of going to the field without having done the little bit of extra research to find the 1877 survey showing the southwest quarter of the section being divided into the east half of the entirety of the quarter section and the west half of the entirety of the quarter section.?ÿ Being Section 30, the so-called west half of the quarter section would normally be Lots 3 and 4 rather than the West Half of..........
This was within 15 miles of the office, BUT if it had been far away, a rush job and doing the fieldwork on a weekend, many surveyors would have set bars at the northwest and southwest of the east half of the southwest quarter per what the GLO Field Notes indicated.?ÿ In my case, that would be an error of about 80 feet stretched over a half mile.
In my experience they are not educated. Most don't even realize that these corners have official names. A good way to convince them is present them with a situation where what should have been the same corner were treated as distinct corners. The same reasoning applies to layman. It's easy to recognize and pinpoint?ÿ a problem when your neighbors deed calls for the same corner as yours, but they are located in two different places.?ÿ
There are even surveyors out there who are convinced that the NW corner of the SE1/4 is not the same as the SW corner of the NE1/4.
This naming convention is in opposition to the very purpose of the PLSS.
