Greetings all:
I'm new to surveying and work on a field crew for a firm in Illinois. Over the course of 3 years my boss (the L.S.) has had us (the crew) quite often pull up another surveyor's pin and throw it away if it did not agree with his calculations. One time recently he was having a disagreement with another L.S. over the placement of a particular pin; and before he got a response from the other L.S., he had us pull the pin and RESET IT 4' +/- EAST. So now this pin with L.S. #2's name on the cap is now sitting in a place where he did not want it set and I doubt he knows anything about it.
I have 2 questions: Is this legal? If so is this common?

It certainly isn't right but not necessarily illegal. Check in the state statutes and see what you can find on the subject. There is a fine for disturbance of survey monuments in some states. I would as a minimum make an anonymous phone call or letter to the other surveyor.

The dude may just have made a bet with one his buddies to get fifty replies in less than 60 minutes...
If I caught him having any of my monuments pulled/moved/destroyed he would no longer have anything left at the lower end of his spine on which to sit. I might go to jail, but, he would go to the hospital for a long stay.

Wow, thanks for the quick responses. I actually have met L.S. #2 and he's a nice guy. I guess I'll see if he wants to have a beer and I'll bring up the subject. First I'd still like to get a little further clarification on this from whoever is in charge of these things for Illinois. Would it be the IPLSA? Is anyone here from IL or know who I should contact?
It is legal to move a survey monuement in Illinois. I need to
look up the statute. I know several surveyors including a former
Illinois board member who move state ROW concrete monuments that
were intended to be set on the ROW and intersection of a property
line or aliquot section line.
Moving another surveyor's monument and leaving the cap on does not
sound like a good practice.
You don't ever move another pin. You set your own if you disagree. Your being taught wrong.
Does this same surveyor have you set old rebar and pipes to help his cause and calls them out as "found"?
You and your crew are being taught wrong ethical practices and it should be reported to the board and also LS #2. He is not protecting the public by doing this.
i am not the smartest guy in the world but anyone who pulls up another surveyors corner is dumber than me. if you pull it up how are you supposed to prove it was wrong?
Below is the law in your state
(765 ILCS 205/11) (from Ch. 109, par. 10.1)
Sec. 11.
Any unauthorized person who knowingly damages, destroys or removes a stake, pin, monument or other survey marker shall, be guilty of a Class A misdemeanor. For purposes of this Section, a surveyor who moves a stake, pin, monument or other survey marker for the purpose of correcting a survey is an authorized person.

MA has a small fine of up to $100 or $250 or 6 months in jail

has your boss ever been to court over a boundary dispute? was his opinion of a boundary supported by the court? i know his monument method would not be, but if he is right every single time, then he's just fixing those mistakes that everybody else makes.
i would assume that you will not turn him into the board if you want to keep your job. and being the low man on the totem your discussion regarding the practice will fall on deaf ears with a defensive, angry boss. good luck, pass your SIT or that Survey Technician Certification thing and go find a job with a legitimate surveyor.
This cannot be true... you're just posting this to see what kind of response you'll get... It's a good one though... If true... you are in a though spot he needs to be reported to the state board...
