Massachusetts Monumentation Regulations/Laws?

I'm trying to find any information that exists on ordinances, regulations or laws regarding rebar monuments to mark residential lot corners in MA. More specifically, I wonder if there is anything written into MA law or regulations offering guidelines for length of rebar, whether being capped is mandated, etc. If anyone knows of anything or can point me in the direction of any resources it would be greatly appreciated!

The Land Court Manual of Instructions of 2006 describes monumentation requirements for registered land. I am unsure of requirements for unregistered land as I just use the Land Court requirements for both.

6) Monumentation. Lines shall be marked on?the?ground such that, in combination with the monuments recovered:

(a) Sufficient monuments exist to enable future surveyors to reliably reproduce the lines as surveyed, even if some of the referenced monuments are compromised over time. Referencing coordinates are not a substitute for setting physical monuments.

(b) The size, composition and material of newly set monuments shall:

1. Be sufficient to minimize the likelihood of disturbance due to acts by mankind or natural causes;

2. Be stable enough to adequately meet the accuracy standards of the survey;

3. Have a life expectancy of 25 years or more under normal circumstances;

4. Be detectable using generally employed surveying techniques; and

5. Be identifiable, with reasonable certainty, as having been set by the surveyor.

I have been told by members of The Board of Registration that items 5 means that the monuments carry caps.

In addition, many towns Planning Boards require monuments as part of the subdivision control law.

This seems somewhat like a loaded question... 🙂 🙂 Do you have a client that is refusing to pay you to set proper monumentation?
