Hello, hope things are well with you all, I'm not registered in California but I've been asked to scope out a project near Stockton. It divides out a 55.62 acre mitigation preserve which includes wetland mitigation and aquatic ponds. The southerly boundary is Little John's Creek, I've been searching through California Code/Navigable Waters and the recent changes. I'm thinking Little John's Creek is?ÿ non-navigable and the boundary would be the thread of the stream and also the call out for "Perpetual Easement State of California" pertains to the bed. I'm not sure if the ordinary high water mark is the determining mark along the bank. I'm not 100% sure of any of this but I'm working on it, if anyone is interested in sharing their knowledge of this subject I'd be grateful. We are also looking for a sub to do this work, let me know.?ÿ
Thanks, Paul
Did you try reaching out to the surveyors at State Lands for their thoughts on this?
@ric-moore Hi Ric, thanks for the suggestion, will keep you posted.
Evan Page was a great resource for this type of discussion. He left State Lands and moved to Oregon a while back, but I think I recently saw him post on this forum, so maybe he will see this thread. I concur with Ric - contact the State Lands survey staff to confer.
Evan lives and works in Idaho now. He does post on here on occasion.
Yes, Idaho not Oregon. I stand corrected. He lived not far from me and we had the same Post Office, so I occasionally bumped into him.
