We completed a boundary survey combining numerous parcels owned by our client. The plan has been recorded at the appropriate registry of deeds.
I just received the Schedule A which has two descriptions. The first under the heading of "Proposed New Legal" references our plan. The second under the heading of "Formerly described as" lists the individual description of each parcel.
Two questions:
1. Has anyone seen this before?
2. Which one is the current description per 6.B.1.?

2. Gut reaction: If it was recombined (officially a single, new tract that did not previously exist), your current map is the basis for a current/ correct description.
My only issue would be with "Proposed New". Don't see where anything is proposed, as you have already properly filed the plan. I don't think that "Formerly described as" is even necessary. But, I wouldn't be scared of it.
Reflecting as I type: If no conveyance under the new map has transpired and no associated deed has been recorded, no formal description has been created/ recorded from your new map? Maybe that's where "Proposed New" comes from?
