Anyone have some favorites or interesting ones? Been going through the ones in Evidence and Procedures for Boundary Location 6th edition Iƒ??m sure thereƒ??s more good ones out there!

The ones I like best are not those that deal with complex legal issues, but rather those that tell a story about how the case ended up in court and offer good explanations of the legal principles involved.

For example McGlothlin v Livingston (OK) starts off with "East landowners son shot west landowners dog...."

Nooteboom v. Bulson (OR) tells the tale of occupation that perfected long ago, followed by a long period of disuse.?ÿ

Idaho surveyors should read State ex rel Evans v Barnett. It's a good lesson in standards of evidence and use of the manual in State authority surveys.

Check into publications by Brian Portwood. He published books about numerous cases in various states that makes for interesting reading. Know for sure he has case from?ÿ ND, SD, MT and other states. They are titled "The Land Surveyors Guide to the Supreme Court of North Dakota", etc etc.

Amazing work by Brian Portwood that I think has gone a bit unrecognized and underappreciated. I have the first two editions of Oregon, and inside the front cover, he lists what he has done. North Dakota 2010, Montana 2011, South Dakota 2012, nebraska 2013, Kansas 2014, colorado 2016, and Oregon was 2018 volume 1 and 2019 volume 2, then the Pandemic hit. I need to follow up with Brian and see how he is doing. Hopefully, his work and passion for compiling cases in a state will not end with Oregon. I really love his writing style as it is storytelling along with case quotations.

The Kentucky Association of Professional Surveyors published a book on every surveying court case that was on the books in Kentucky as of about 7-8 years ago.?ÿ The whole thing is very interesting reading.?ÿ I'm pretty sure there are more books left.

CAMB v Morales CO 2005.

The court ruled that in a 1980 subdivision of 10 five acre tracts with all original monuments found in good position except two, lying 13 feet south of a 90 foot platted line dividing two vacant lots, the original monuments prevail because the 1980 plat certified that all required monuments "were set".

It's why Virginia Title Co.'s won't insure for easement's in VA without a metes and bounds description. It has created a huge mess.?ÿ
