Years ago I did obtain some standard forms and filled them in with a typewriter for small transactions where I was purchasing a few low value tracts.
Have never even considered preparing a deed for anyone else.
Let the attorneys, title companies, real estate brokers, lenders, etc. handle that function as they do that sort of thing routinely as a part of their job function.?ÿ It is not the job function of a licensed land surveyor to prepare such documents for the public.
I did a survey for a client that prepared the Deed when he paid cash for the property.?ÿ No title company involved as far as I know.
I would caution against preparing Deeds for another person on a transaction you aren't involved in.?ÿ A person only needs a law license to represent someone else; they can represent themselves or write their own Deed.
I just don't get the auto correct on my phone. It changes what I write to nonsense more often than it helps.?ÿ
I just don't get the auto correct on my phone. It changes what I write to nonsense more often than it helps.?ÿ
That's spelled auto-incorrect.
I don't even like calling them, "legal" descriptions.?ÿ I usually call them "lot" or "parcel" descriptions
I will correct my first post, I have prepared deeds for filing.?ÿ I spent a fair amount of time doing right-of-way work for a large telco utility and wrote hundreds of easements.?ÿ They had a standard easement deed template that I utilized, filling in the provided grantor info.?ÿ The right-of-way agent took over from there.?ÿ In this case it was a pretty simple thing and just expediated the process.?ÿ
"Legal description" is an awful and misleading term. Your terms sound good. I use "land description".
I think what you describe is a clerical function. The client gives you the form and has you fill it out, this is not a problem. The only professional function is preparing the description.
Valid? Sure. But it isn't always wise to do a thing just because you are allowed to.
I write legal descriptions, I'll leave the deed preparation to the experts in that field.
Yes, I said legal descriptions; if you aren't writing legal descriptions, are you writing illegal descriptions??ÿ
The use of the word "legal" isn't practicing law.?ÿ

Filling out a deed form is one of the easiest parts of the process apart from advertising the property is for sale, which takes a for sale sign.
I have several clients that have always filled out their own deed forms and some that hand wrote it on yellow pads, got their witnesses and notary information on there and spelled out the grantor's intentions.
It may change, the local Title Companies are still doing turnkey paperwork and sending the surveys to proper people that need to approve the loan and sale.
Every Title Company has an attorney on retainer or as a partner or officer in order to make legal decisions and if they are beginning to not offer the making of deeds and such as needed to close a transaction, I will never understand why they don't.
