I recall a thread a few months ago discussing the merits of showing a private easement on a subdivision map. John Stahl was one of the posters and made a few good comments, as did many others.

I'm in a ... contest with a non-surveyor reviewing my subdivision map. I'd like to show the private drive/utility easement on the map to make sure that it doesn't get lost in the shuffle down the road.

Her comment: "A private easements shouldn’t be shown on a map because at the time of the map is recorded , there isn’t an easement yet. That is the reason for the Agreement for Conveyance of Easement to be required with the map condition."

I've seen too many "lost" easements to be comfortable with this and want to show the linework and dimensions on my map.

I've search high and low on this site for the thread but can't find the bloody thing.

Can anyone help me out if they recall where Wendell hid the thread, please?

I'm sure there's a better way, but what I did was:
Clicked on my login name up above
the next screen that pops up is your profile, click on user area and all of the users pop up(something I like about this page is, at the bottom, all the people on line are shown there)
Find JBSTAHL, I typed jb in the search box and hit enter, I didn't see where to click a button.
All of the posters with names that start with jb popped up.
I clicked on JBStahl and then clicked show postings.
I then found one of the posts to thread you are talking.
Now this is the part I'm not really sure about. In the bottom right hand corner there is a button labeled link. I clicked on it but nothing happened.

That was one of the threads I remembered.

I was certain that it was a couple of months ago. The last post in the "Springing Easements" thread was in March of 2010. The last post in the "Can private easements be shown" thread was in February of 2009 and had a wonderful post or two by my late friend Paul Cuomo.

Seems like kind of an odd request IMO. If they are existing, just reference the recording information. If they are new, then the owners grant/dedication certificate and subsequent approval & acceptance certificate by the city/county - they are automatically created upon recordation of the plat. Just like every lot in the subdivision, it's simultaneous.

I think I'd be asking for the section in the ordinance that references that stuff, because no doubt it's there. Or simply talk to her supervisor for a come to jesus meeting.

In our area we often show such easements, in fact are required to do so by some authorities, as "easement to be granted by separate instrument". Those granting documents are recorded with the plat and the recording data is entered into a list on the face of the plat by the person recording the plat.
Of course, sometimes they don't get recorded when the authorities do the recording!
