A true pre-employment drug test would not have to be payed for, but if the company dictates the time and the place they must report it probably needs to be compensated for. The requirement to report 10 minutes before starting work is also highly suspect. Of course the legality of the practice depends on the specifics of the case. I doubt that this is legal. They are requiring her to do this as a condition of employment so it is part of her working day, for which she should be paid. But as others have said, I don't think I would make a stand over this. I would make a note of it - time, date, exactly who said exactly what and who else was present - in case this escalates into a series of intolerable abuses.

When they are already employed. that sounds stinky to me.

I had to do a pre-employment drug screen and physical for the job I just landed last month. I had to put up $ 30 for the test which I would get back if I came up clean and healthy. I thought that was BS but I did it because I wanted the job. I knew I was clean so it was no risk to me.
