Yeah, I think the real question is not how it was approved but how or who staked it out on the ground.:-/

The original court ...

Surely, the common pleas court record should have evidence of who forwarded an opinion on the line location and a given location to build a house.

If the "survey", was done by the engineer, did the engineer intend to "fool", the governing agency? Did the developer decide he needed a more viable building location(that pond bothers me), and took a chance?

Who were the surveyors for the plaintiff, defendant and maybe even for the court and did they have differing opinions?

Evidently, this last court only ruled on the remedy.

Jered,

Yes, that is the 1.8 million dollar question, isn't it? However, if my rough understanding is correct, I would bet that no one staked it, unless you count the general contractor "staking" it for himself based on that site plan that he passed off as a survey of some kind. I really don't see that anyone formally staked the foundation/house location.
