Attorney...can you confirm that the underground utilities are all located within the highway right of way?
Adam..... the utilities were painted on the ground by the locators on a certain date at a certain time. Those paint marks are what was located by survey. I have know idea what is sub surface and cant make any statement as to their true location other than I located the paint marks.

I remember Larry P talking about this. his comments were along the lines of; the attorney will mark the box that says he asked and you and you said no. When he reports back to his client he'll say: yeah, I asked the surveyor and he refused...

I cannot confirm the gentleman who showed up was a real employee of the locate company, as he performed his work in a manner that could or could not be described as possibly efficient, and it was never explained to me that the machine he held in his hands was any type of device that located utilities any more than it was a device for locating ice cream cones, and the paint he sprayed on the ground was from a distance of several inches off the ground, in which the paint, during this travel time, was allowed to drift with the prevailing wind for some unknown distance and quite possibly made any attempt of marking any utilities a gamble at best.
