Spanish Grants in Arkansas

I ran into something interesting today.

I have been hired to help a fellow surveyor with a project. They are not licensed in Arkansas. They are creating a conservation easement in the Tennessee side of the state line. I have been asked to create an ingress egress easement from the end of a gravel road maintained by the county in Arkansas, to the Tennessee Arkansas state line. Not to big of a deal, right? (The property is on the West side of the river)

Well, in my research, I found out how different Tennessee and Arkansas records are kept. Once I got that figured out, it was a little easier, but now my little piece of the world lies in a Spanish Grant, east of where the PLSS stops just before the Mississippi River.

This one is getting interesting. Arkansas state law requires that the easement be tied to a section corner, at least the way I read it. I found one today, but it is not the most convenient to tie to, but I am hoping it will do.

Has anyone ran into these Spanish Grants in eastern Arkansas? I am working in Crittenden County. Everyone at the Tax Assessor's office and the Court Clerk's office have been VERY helpful. It's just that this stuff is OLD, and this is the first project I've ever worked on in this county.

Not Familiar with Arkansas, but any Texas surveyor can help you with Spanish Land Grants. Several other states also have them but Texas has the most.

Surely there is an exception for tieing to a section corner if the property in questions wasn't sectionalised.

That is what Jay and I were talking about yesterday. I am going tio send an email tio the Board, and see what they say. I think I am covered with the section corner I located. It can be recreated pretty easily.

Tell the board that since the land wasn't sectionalized, Arkansas doesn't have any authority over it, and you're going to call Nicolas Sarkozy and ask him the proper procedures for surveying remnant French land in North America.

Tie the section corner, and dot your I's and cross your T's. The Spanish Land Grants can be fun to deal with. Also be sure to file your plat. It sounds like a fun project. Also be sure that you have a certificate of authorization from the Arkansas Board. Those are the things surveyors get theater hand slapped for. If you took a hand held position on that section corner, and it is far enough away from your project, you might be able to meet the positional accuracy standards.

Thanks for the information. I did find a section corner, and I show it as a tie on my plat.

I will be sending an email to the state surveyor and maybe even the board with a question or two.
