Prior to the easement existing, it would be labeled, "proposed". If it is only proposed...then that is what you should say. If you were to show an easement on a plat, and didn't label it proposed, then you are saying it exists. In the OP's case, I am assuming that the easement didn't exist when he signed the plat, therefore he has to label it the way that it really is (not the way he hopes).
Except you have a dedication on a subdivision plat. And if you show an easement, then you are dedicating that easement. And, all future surveyors will have to show that easement as a special exception on all future ALTA surveys. It shows on the plat.
Back on topic, has anyone ever gotten bent over for not using "proposed"?
No, Use it all the time on "Proposed Subdivision Plats" as you say its all proposed until some other instrument makes it not.
I've never seen a Subdivision that says "Proposed XXX Subdivision" that's a new one. Nor have I ever seen a description that starts with "Proposed Tract of Land".
