I have a question for those practicing in NY. Is construction layout work regulated by the Survey and Engineering Board? i.e. Do you need a survey/engineering business license to do it, and or do you need a PLS/PE to do it under?
This is for a total of 22 points in the middle of a sod farm to put up some solar panels.

The legislation reserves a few different terms for sole use of those licensed, any of which are fine to use. They just had to pick one to go on everyone's paperwork and picked LS for one reason or another.
So, call yourself PLS, LLS, LS, RPLS, just don't be late for supper.
And don't perform construction staking (for hire, or offer to for hire) unless PE, LS, or under the direction of. If you are building something I think you can use your own people to perform your own construction staking if you are a contractor.

I doubt a farmer has to hire a PLS, PE, etc. to put up a couple of solar panels in the middle of his land.

In NH, I recently JUST had that issue pop up, and the Code enforcement officer required the land owner to seek a Planning Board Site Plan Approval for solar panels to be installed in a quasi commercial use operation.
SP Approval is still being tabled due to zoning issues, and land owner now is considering seeking ZBA variance to proceed.
So... it depends.
Maybe the farmer can just do it.

If you are showing it on a map in relation to a property line (even if it is GIS data) then yes. Otherwise no. I know a lot of construction guys who do layout for buildings, site work, etc who are not licensed. Many construction companies have their own layout divisions that use CAD, RTK, and total stations to layout their own work without an LS.
Just be aware that a lot of construction contracts require the layout to be done by a licensed surveyor...and you won't be able to supply as-built info since that usually has to show property lines.

They do but it doesn't matter what they think. The State says otherwise.

Many construction companies have their own layout divisions because they assume the liability. If you are to sign any Construction Survey Agreement in my neck of the woods you will need to provide some Professional liability insurance. The operative word there is "Professional".
I've been in this game for a few 24s. So I believe I know what I'm talking about.
Right but that's contract based...not State Ed based. You don't need a license to do layout unless its required in the contract. I don't agree with that, but I believe that's the case. I know a couple of guys who are union based who do their own thing doing only layout with no license. They have insurance...just not professional liability.

Ralph, I don't think so, but maybe they changed things. My stamp says LLS, not LS. But I'm pretty sure in one section of the law or another (or a regulation or commissioner's rule) it reserves the use of the title PLS to those licensed. Crazy NY law and regulation. You want to find something out about the law in another state, no problem. In NY; good luck, I can probably find a conflicting section. It's a nightmare.
In fact, if it's not mentioned then I guess anyone can call themselves a professional surveyor in NY.
§6513 Unauthorized use of a professional title a crime.
1.Anyone not authorized to use a professional title regulated by this title, and who uses such professional title, shall be guilty of a class A misdemeanor.
