That argument has lost many times in state courts too.?ÿ

Local governments have a very strong well established power to regulate land use. They can't arbitrarily create requirements for specific properties but they can do almost anything?ÿ if it is line with "broad legislative goals" or something like that.?ÿ

Most every time a planning board changes existing rulings or makes new rulings, it is to the advantage of someone in control of that board. This comes from a lifetime in rural areas and small towns.
