This paragraph in the restrictive covenants contained in a deed I'm looking at has to qualify as either a triumph of imagination or of optimism:
Restrictive Covenants:
Each existing and future owner, occupant, tenant, VAGRANT, TRESPASSER [my emphasis], or other person, firm or corporation owning, claiming, using, possessing, controlling or managing any part or all of TRACTS 1 through 19 shall be bound by, shall obey, and shall be responsive to the restrictions expressed hereinbelow.
In other words, if you are a trespasser in adverse possession of any part of the land, we sure would like to hope that this whole list of restrictive covenants still applies to you. And what a great advertisement for the expected quality of the subdivision residents, too.
Time to start telling lawyer jokes. Someone, somewhere, at some time, developed the line of thinking that resulted in that strange collection of words. It makes one wonder what set of circumstances led that person to develop the thought that there was a need for such phraseology. Further, how would the list of covenants be impacted if most of the phase listed above had been left out?
Seems to cover all the bases. Good luck with that one.
They need to cover extra-terrestrials and invading armies too.
