Around here you adhere to obtain a building permit. The City has no course of action after the house is built.
Famous local law suit: Daddy divided his 20 acres into 4 five acre tracts in 1968. His three daughters each were deeded a site and the folks kept their five. After 30 years there was a house on each five acre lot. In 1997 the City created the ordinance that keeps tracts smaller than 10 acres from being "created". Of course, everything that happened prior to that was "grand-fathered". This included the 4 homes previously mentioned.
For some reason all the daughters deeded their five acres back to Dad's estate in 2000 for financial purposes (yeah, I don't know either), oblivious to the City's ordinance. When Pops finally passed in 2005 the daughters had the trust deed them back their five acres each(with a 25 year old house upon it)...and one wanted to sell and move to Florida.
The County would not record the conveyance and said the 2000 conveyance created a 20 acre tract and therefor could only be divided into 2 ten acre tracts. The property owners held the structures (all built between 1970 and 1980) fell in the "grand-fathered" category and the 2000 conveyance was for financial purposes only.
Long story short the daughters won. The courts ruled the '10 acre minimum' ordinance was created to control new building density and (this is the important part)...could not be used to deny or impair the sale of an existing structure. The ruling fell short of specifying the age of the house or structure. There is some key wording in the devilish details, but the City Attorney is a little gun-shy to throw around the term "illegal lot" when an existing structure is involved...apparently no matter the year of construction. This is why the city officials cry and whine when a home mortgage with less than 10 acres gets recorded.

As for the "greybeard" part of it. Yes, it does exist. However, it is a bit annoying when I have to shove it to the side in order to button the top two buttons on my shirt, not counting the only-button-it-when-a-tie-is-being-worn-button. Lifting it out of the inside of my tee shirt is how I start my day.
