I don't see how the BFE plays into it at all, what makes me want to call it a 1A is the fact that the lower floor has been converted to living area.
Seems I can recall that TPR stated that you can walk out of the lower living area to the back yard.
The key, to me, is how is that area being used, and it looks, to me, that it is intended to be used as a living area.

I don't think I've ever read in the instructions that we are to make some kind of determination on how the space is used. We are describing the status of the construction of the building in space, relative to the flood zone.

Actually, it does say in the description of 7 that the "principle use" is on the elevated floor, so I think there has to be some determination made as to the use. Now, I don't know what "principle use" really means, it would be nice if they used words like "living area" in their description. The lower floor could be considered a family room, and has a bathroom. In fact, if you brought in a stove and fridge, it could an apartment.
