Deed: Excluding and Including Conveyance to Center Line of Street

After some sleuthing, I found the property.?ÿ?ÿ

The towns code appears to currently be 10% max grade for a residential driveway. A surveyor can do an as built?ÿ survey of the driveway as is to see what the grade is today. Also, since your dad inherited the driveway, it could be helpful to find out what the town code was when your dad acquired it.

If you decide to invest a little in the property to make it marketable, send me a message through the forum. I'll give you a couple of names of local surveying/engineering firms. Until then, bug the realtors ;)?ÿ

@kjypls good detective work!  I will contact you via the other section of the forum. 

I did spend most of my day at the county seat looking up deeds.  I was able to trace the property back to 1891 yet still, it is references as the same acreage and same metes and bounds that I currently have, which means there must be yet an older deed or document that I need to find that would say something about my parcel being carved out of another parcel - that's the one I believe I need to find. 

As well the deeds I read today, none of them mentioned easements, ROW's or right of passage over other properties, which is key for me here.

There was a deed prior to 1891 yet it was sooooo difficult to read most of it was illegible.

A surveyor can probably help you read the deed. Reading bad handwriting is a part of the profession.

If you don't know of any historical access besides the driveway there is a good chance there  isn't an easment. I am sure there was no maximum grade required to build in 1891. Doesn't the town have a method to apply for a variance?

Yes the town does have a method to apply for a variance.?ÿ I shall look into that, but I was told by an official of the town the grade was excessive but that they could ". . . work with me. . . "?ÿ Upon follow up for recommendations, the best ". . . work with me" solutions from that party was to contact the surrounding land owners and see if they would grant or sell me a ROW. Which I did, to no avail.?ÿ I even contacted the Town, which owns an adjoining property, and they, too, were unresponsive.

Oh well, I will definitely follow up on all of these great suggestions offered here.?ÿ I want to thank everyone for offering their expertise - truly a great group of people on this forum.
